1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement entered into between Paradespalpatch Technologies Ltd. ("Company", "we", "our") and the enterprise entity or individual user ("Client", "you") accessing or utilizing paradespalpatch.yachts, including associated software modules, APIs, and architectural documentation. By accessing our web properties, submitting technical inquiries, or licensing our agent software, you explicitly accept and agree to abide by these Terms.
2. User Obligations and Acceptable Use
The services provided by Paradespalpatch are engineered exclusively for lawful enterprise operations. When interfacing with our platform, you agree not to:
- Execute, attempt, or facilitate indirect prompt injections, jailbreak vectors, or model extraction attacks against our agent runtimes.
- Ingest data that violates intellectual property protections, trade secrets, export control regulations, or applicable data privacy laws.
- Deploy autonomous agents to execute malicious cyber operations, unsolicited bulk communications, or unlawful automated decision-making without requisite human oversight.
- Reverse-engineer, decompile, or disassemble proprietary orchestration adapters or schema translation engines provided under license.
3. Intellectual Property Rights
Platform Intellectual Property: Paradespalpatch retains full and exclusive ownership of all software code, architectural methodologies, system designs, logos, trademarks, and documentation published on paradespalpatch.yachts. No ownership rights are transferred to the Client except as explicitly detailed in a signed Master Services Agreement.
Client Data & Generated Output Ownership: As between Company and Client, the Client retains all proprietary rights, title, and interest in and to all proprietary data corpora grounded into the system. All deterministic outputs generated by autonomous agents acting under the Client's direction belong entirely to the Client, subject to underlying third-party foundational service terms.
4. Disclaimer of Warranties and Operational Limits
While Paradespalpatch builds deterministic guardrails and automated schema validators, generative artificial intelligence systems are probabilistic by nature. The platform is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Clients remain solely responsible for configuring appropriate Human-in-the-Loop approval gates for high-risk transactional procedures.
5. Limitation of Liability
To the maximum extent permitted under applicable law, in no event shall Paradespalpatch Technologies Ltd., its directors, employees, or infrastructure affiliates be liable for any indirect, incidental, consequential, special, or punitive damages—including lost profits, operational interruptions, loss of business data, or downtime expenses—arising from the use or inability to use our systems. Our total aggregate liability under any cause of action shall not exceed the amounts paid by the Client to Paradespalpatch in the twelve (12) months preceding the incident.
6. Termination of Access
We reserve the right to suspend or terminate access to our API endpoints and platform documentation immediately, without prior notice, if we detect reasonable evidence of security compromise, unauthorized prompt injection research targeting production services, breach of these Terms, or non-payment of subscription fees under commercial contracts.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to this contract shall be submitted to the exclusive jurisdiction of the competent courts located in London, United Kingdom.
